Teva, the world’s largest generic drug maker, has been given a new lease on life in the face of intense competition for the lucrative erectile dysfunction drug Viagra.
In the first of its kind, a competitor to Pfizer’s rival, Eli Lilly’s Viagra, has made a name for itself by offering generic versions of its famous drug for patients with mild to moderate erectile dysfunction.
This is not the first time Eli Lilly has been hit with competition for Viagra, but in the past year the company has faced a major challenge.
With Pfizer’s patent for Viagra, a drug for which Lilly has already patent protection, there was no choice but to give up its popular erectile dysfunction drug.
The patent on Viagra is due to expire in 2013, and will be subject to a huge period of negotiation by Lilly, who have yet to announce any deal.
Lilly’s Viagra patent for the impotence drug expired last year. That means that its market share will also be reduced. In addition, the patent on the anti-impotence drug Levitra has already expired, but the patent on Viagra remains in effect. Pfizer has yet to make any announcement.
But as the Viagra patent for the treatment of erectile dysfunction expires, Pfizer will have to pay a huge price for its ability to sell its drug for so long.
Lilly, which has a patent on Viagra for about 10 years, will have to pay a staggering $7 billion to settle claims in the US, including $2.3 billion for a generic version of the drug, according to the US based IMS Health.
Pfizer, which is considering other generic versions of its drug for patients suffering from impotence, has had to pay some of its own patent attorneys to settle claims in the US. The company has to pay them in full.
Lilly’s decision to pay the companies is based on their belief that the patent protecting Viagra would expire in 2013, meaning that the patent for Levitra would no longer be valid. However, the companies are not willing to challenge Lilly’s decision to pay for the Viagra patent.
Lilly is planning to make an official announcement later this year, though there is no guarantee that the company will make the same announcement for the Viagra patent.
